Harry A. Margolis, a caring judge, 74

Saturday, August 03, 2002

A dispute over building repairs between a developer and a group of condominium owners in Bloomfield might not have seemed like the most exciting case to preside over.

But to Judge Harry A. Margolis it was an opportunity to make sure people were treated fairly. The case dragged on for several years, but the judge, then sitting in state Superior Court in Newark, stayed focused.

"He never lost interest in it. He really showed a lot of concern for these homeowners who were caught in the middle," said lawyer Jay Rice, who handled the case and later asked the judge to be of counsel at his law firm upon his retirement from the bench.

That was the kind of jurist Judge Margolis was, his friends and colleagues said.

"In addition to doing the right thing, Harry Margolis was a judge who cared about people," said Harold Braff, a Livingston attorney and longtime friend. "He loved the idea that as a lawyer he was given the opportunity to speak for those who couldn't speak for themselves, and as a judge he was in a position to do justice for whoever came before him."

Judge Margolis, who lived in West Orange, died Thursday at Saint Barnabas Medical Center in Livingston. He was 74.

Judge Margolis was appointed to the state bench in 1972 and served full time until 1998. During his tenure, he served as presiding judge of the chancery division for many years. Following retirement, he was asked to return to the bench part time. Two years ago, he joined the law firm Nagel, Rice, Dreifuss & Mazie in Livingston.

"He was what a judge should be, quite frankly," said Superior Court Judge Joseph Falcone, the assignment judge in Newark.

Judge Margolis not only made an impression on his contemporaries in the courthouse, but also on younger members of the bar.

In 1987, he helped found the Justice William J. Brennan Jr. Inn of Court, a program that provides mentoring and guidance to inexperienced members of the bench and bar. He was president of the organization for more than a decade. Today, there are roughly 20 inns of court in New Jersey.

"He would always have time to speak with people one on one," said Jeffrey Beacham, a Roseland lawyer who took part in the program's classes. "I would see him at the courthouse and he would pull me aside and go back in chambers and we would talk. ... It helped me a lot. It made a big impression, I felt more confident."

Judge Margolis was also active in the community. He was a past president of the West Orange Lodge of B'nai B'rith and was a member of United Jewish Appeal campaigns.

In addition to his many friends, Judge Margolis is survived by his wife of 51 years, Frances Margolis, and a daughter, Dale Margolis of Pennsylvania.

Services will be held 2 p.m. tomorrow at Bernheim Apter Kreitzman Suburban Funeral Chapel, 68 Old Short Hills Road in Livingston. Burial will be at Mount Lebanon Cemetery in Iselin.

Memorial contributions may be made to the American Inns of Court Foundation, c/o Don Stumbaugh, Executive Director, 127 S. Peyton St., Suite 201, Alexandria, Va. 22314.
